1. Introduction

Welcome to the official website of United Principles Fund ("UPF," "we," "us," "our") (the "website" or "site"). UPF is an independent-expenditure-only political committee registered with the Federal Election Commission ("FEC"). We understand that visitors to our website may have questions about how this website collects, uses, and shares information. This Privacy Policy explains our privacy practices, including the information we collect from you when you use our website, apps, and other digital and online services (collectively, the "Services"); how we may use that information; our rights to share, sell, rent, exchange, and disclose such information to third parties; how you can review and modify information that you provide to us; and your choices regarding our use and disclosure of such information. Please review our Terms of Service, which govern your use of the Services. Any capitalized terms that are not defined in this Privacy Policy shall have the meaning ascribed to them in the Terms of Service.

This Privacy Policy only applies to the information collected by us and any third parties acting with our authorization, or information otherwise provided to us by third parties about you, in each instance in connection with your use of the Services. This Privacy Policy applies regardless of the computer, mobile phone, tablet, or other electronic device ("Device") you use to access the Services and whether you are accessing the Services as a registered user or otherwise.

Please read Section 5 carefully. It explains that, to the maximum extent permitted by federal law and applicable state law, we may share, rent, exchange, or sell the contact and contribution information you provide to us with other political committees, nonprofit organizations, vendors, data cooperatives, and commercial partners for any lawful purpose, and that by providing information to us you consent to this. Section 9 and Section 10 explain the choices available to you, including your right to opt out of the sale or sharing of your personal information where state law provides such a right.

By using the Services, you agree that your use of the Services is governed by this Privacy Policy and our Terms of Service. From time to time, we may update this Privacy Policy. We encourage you to periodically check this Privacy Policy for updates. Your continued use of the Services affirms your agreement to any changes we make to this Privacy Policy.

2. Information We Collect About You

A. Registration Information. In order to access and use certain features, content, or functions of the Services (e.g., contributions, communication or networking features, petitions, surveys, volunteer sign-ups, etc.), you may be asked to provide certain information, including your name, username, password, email address, telephone number, date of birth, mailing address, ZIP code, occupation and employer information, and other descriptive information.

B. Contributions and Payment Information. If you make any contribution (including any purchase) on or through the Services, your payment information (e.g., credit or debit card type, number, and expiration date) and related information (e.g., billing address) may be collected by us and/or our third-party payment processors. We also collect and retain a record of your contribution history, including the amount, date, and method of each contribution.

To comply with federal election law and the regulations of the FEC, we are required to use our best efforts to collect and report the name, mailing address, occupation, and name of employer of each individual whose contributions aggregate in excess of $200 in a calendar year. Information reported to the FEC becomes part of the public record; see Section 6. Generally, contributions are non-refundable. Should you choose to contribute, you will receive an email confirmation of your contribution.

C. Information You Choose to Provide to Us. We collect any information you provide to us on or through the Services or in any other way. For example, we collect any information you provide when you update your user account and profile ("User Account"); sign a petition; participate in surveys, polls, and other engagement activities; contact us; volunteer; and sign up to receive newsletters, email, and text message communications.

In addition, the Services may include features that rely on the use of information stored on, or made available through, your mobile Device. We may also ask to collect or use the specific location of your mobile Device (e.g., by accessing your Device's GPS). If you agree to allow access to your location, you agree that we and our service providers may collect such location-based information from your Device. We may also collect other information based on your location and your Device's proximity to "beacons" and other similar proximity systems, including, for example, the strength of the signal between the beacon and your Device and the duration that your Device is near the beacon. The type of location data we collect depends on a number of factors, including the type of Device you are using (e.g., laptop, smartphone, tablet) and the type of connection enabled on your Device (e.g., Wi-Fi, Bluetooth, broadband cable). Our apps or other features of the Services may rely on this location information in order to provide certain location-based services, such as event information, volunteer opportunities, or other UPF-related content that may be of interest to you. We may also use location information to improve the functionality of our apps and our other applications and services. If you do not wish to have this location information collected and used by us, you may opt out by disabling the location and Bluetooth features on your Device and/or in our apps. As a general note, you may choose not to provide certain information, but you may not be able to access certain content or take advantage of certain features of the Services.

Depending on the Device you are using, we may use third-party services to provide mapping services. For example, we may use Google Maps on certain Devices. You can learn more about the information that Google collects through its mapping services at https://policies.google.com/privacy.

D. User Submissions. You may have the ability to use the Services to communicate with other users of the Services and post comments to or otherwise interact with certain aspects of the Services that are available to the public and/or other users. We may collect any information you submit, post, or provide in the course of such activities, and reserve the right to store any information about the people you contact via the Services.

Any information, communications, or material of any type or nature that you submit to our Services (including, but not limited to, any of our pages contained on a social media platform or website) by email, posting, messaging, uploading, downloading, or otherwise (collectively, a "Submission") is done at your own risk and without any expectation of privacy. We cannot control the actions of other users of any social media platform or website, and we are therefore not responsible for any content or Submissions contained on such sites and platforms. By visiting any of our pages or websites contained on a social media platform or website, you are representing and warranting to us that you have reviewed the applicable privacy policy and terms of use of that platform or website and that you will abide by all such provisions contained therein.

Additionally, in the event that we offer a message board or any other interactive or social-type feature on a website administered directly by us, please be aware that these areas may allow you to publicly post, and share with other users, certain messages, content, or other information (e.g., stories, pictures, etc.). Although we may take certain precautions to protect those who use these areas of one of our websites, we encourage you to be wary of giving out any personal information in such public forums. The information you post can be collected and used by people you do not know. We cannot guarantee the privacy and safety of these areas and are therefore not responsible for any information you choose to post. Your use of these features is fully at your own risk.

E. Usage Data and Technical Information. The Services include features that automatically collect certain information, which may include the unique Device identifier assigned to your Device, Third-Party Platform anonymous identifiers, and other information regarding your use of the Services to, among other things, assist us in authenticating your usage and/or Device, keeping track of your preferences, creating a more tailored user experience, and better serving your particular interests and needs. The Services and/or third parties may use "cookies" (which are small data files containing information about you that are stored on your hard drive), "embedded scripts," "pixel tags," and other similar tracking technologies (collectively, "Tracking Technologies") to collect information automatically as you interact with the Services. Such information may include "clickstream" data, the domain name of the service providing you with Internet access, your Device type and attributes, Internet protocol (IP) address, network connection type (e.g., Wi-Fi, 4G, 5G), browser type and version, operating system and platform, the average time spent on the Services, pages viewed, content searched for, access times and other relevant statistics, and your interactions with content, other users of the Services, advertising, and products and services that are offered, linked to, or made available on or through the Services. Such information may be collected by us and/or our third-party service providers and partners. Certain Tracking Technologies enable us to customize your experience on the Services and provide tailored recommendations, advertisements, and other content relating to your specific interests, including on third-party websites and platforms. Other Tracking Technologies are used to make login to the Services easier (such as by remembering your user ID) and allow us to collect non-specific location information. You can learn more about the use of cookies and other Tracking Technologies on the Services in Section 4.D below.

F. Third-Party Platform Information. If you access the Services via your account on a third-party social media or other platform ("Third-Party Platform") (e.g., by logging in to the Services using your Third-Party Platform account credentials) and/or integrate your UPF account with your Third-Party Platform account, we may collect certain information from the Third-Party Platform, such as your username and other information you provided to the Third-Party Platform in connection with your account (e.g., name, country, date of birth, gender, and email address). You can learn more about adjusting your settings and preferences with respect to Third-Party Platforms in Section 4.A below.

G. Information From Other Sources. We may receive information about you from other sources, including other political committees, nonprofit organizations, data cooperatives, list vendors, publicly available records (such as voter files and FEC reports), and commercial data providers, and we may combine that information with the information we collect from you through the Services.

3. How We Use Information That We Collect

A. Except as prohibited by the terms and conditions of any applicable Third-Party Platform and subject to Section 4, we may use information we collect for, among other things, the following purposes:

4. Opting Out of Certain Uses of Your Information

A. User Account Privacy Settings. You may be able to adjust certain privacy, permission, and User Account settings by responding to request alerts or notifications that may be presented to you on your Device prior to or following the collection of the relevant information, or by navigating to the settings, account, or privacy section (as the case may be) of your Device or the applicable Third-Party Platform and limiting certain Service functionality (e.g., location services, etc.). Please be aware that if you limit the collection of certain information, you may not be able to use all of the features and functionality of the Services.

B. Marketing and Promotional Communications. Recipients of such communications can unsubscribe by following the specific instructions included in such communications, or you may opt out of receiving marketing and promotional emails from us at any time by sending an email to us at info@unitedprinciplesfund.org detailing your request. Recipients of text messages may opt out of our mobile messaging program by replying "STOP" (or "QUIT," "END," "CANCEL," "UNSUBSCRIBE," or "STOP ALL") to any mobile message you receive from us, or by contacting us via the means provided above and clearly communicating your intent to unsubscribe from our mobile messaging program. Please note that opt-out and unsubscribe requests may not take effect immediately and may take a reasonable amount of time to receive, process, and apply, during which time your information shall remain subject to the prior privacy settings. Additionally, you should be aware that any information provided to third parties prior to your election to opt out or unsubscribe cannot be retrieved or rescinded by us unless required by applicable law, and you cannot retroactively opt out or unsubscribe with respect to such third parties.

Please note that in order to keep you informed about the operation of our Services and related services, we may always send you emails and announcements that are needed for the proper functioning and administration of our Services, including for the purposes described in Section 3 above, in connection with your use of such Services. We may also have features that allow you to submit information, questions, or feedback to us. In those instances, we may retain your emails and other information you submit to us for our internal purposes and to help us serve you better.

C. Privacy Preferences. You may also change certain privacy preferences (e.g., choose to cease receiving certain communications, or ask us not to share, rent, exchange, or sell your personal information with third parties as described in Section 5). If you ask us to stop using or sharing your personal information, we will honor that request going forward to the extent required by applicable law, provided that we may retain a record of such information as necessary to comply with applicable law (including FEC recordkeeping requirements), and we may continue to use your contact information to contact you about your Services-related transactions and to respond to your requests, as well as your IP address to determine the country in which you are accessing the Services. Other privacy preferences (e.g., deactivating your User Account, etc.) may be made by modifying your User Account settings on the Services, your Device, and/or the applicable Third-Party Platform. You always have the right to access, review, and correct the personal information you have provided, and generally you may review, update, or delete certain information collected by the Services at any time by accessing your User Account as described herein or by contacting us as described in Section 15.

D. Opting Out of Use of Certain Information That May Be Collected by Tracking Technologies.

Tracking Technologies: Most browsers are initially set to accept cookies and allow local storage, but you should be able to change your settings to notify you when a cookie is being set or updated, local storage is being used, and/or to block cookies and/or the use of local storage altogether. Please consult the "Help" section of your browser for more information. Please note that by blocking any or all cookies you may not have access to certain features, content, and/or other personalization available through the Services.

Interest-Based Advertising: We may work with advertising platforms that use Tracking Technologies to serve UPF advertisements to you on other websites and platforms based on your visit to the Services. You may be able to limit this activity through the opt-out tools offered by the Digital Advertising Alliance at optout.aboutads.info and the Network Advertising Initiative at optout.networkadvertising.org, and through the advertising settings of the platforms you use.

Do-Not-Track Signals and Global Privacy Control: Certain browsers transmit "do-not-track" signals to the websites with which such browsers communicate; however, this feature, and how it is used and activated, varies from browser to browser, and no uniform standard has been adopted. We currently do not take action in response to "do-not-track" signals. Where required by applicable state law, we will treat a Global Privacy Control ("GPC") signal received from your browser as a request to opt out of the sale or sharing of personal information collected through that browser; because a GPC signal does not identify you, it will not opt out information we hold about you offline or in other channels unless you also submit a request as described in Sections 9 and 10.

5. Sharing, Sale, and Disclosure of Information We Collect

A. Sharing, Renting, Exchanging, and Selling Your Information. To the maximum extent permitted by federal law and applicable state law, we reserve the right to share, rent, exchange, sell, and otherwise disclose to third parties any of the information you provide to us or that we collect about you, including your name, email address, telephone number, mailing address, and contribution history and related information, for any lawful purpose, including, but not limited to, the purposes described in Section 3. The third parties with whom we may share, rent, exchange, or sell your information include, without limitation:

Such third parties may use your information for their own purposes, including to contact you with their own solicitations, advocacy messages, and offers, and they may further share, rent, exchange, or sell your information subject to their own policies and applicable law. We are not responsible for the privacy practices of such third parties. Because UPF is an independent-expenditure-only committee, we do not share, rent, exchange, sell, or otherwise transfer your information to any candidate, candidate's committee, candidate's agent, political party committee, or any person or entity acting on behalf of or in concert with a candidate, campaign, or party — whether for monetary consideration, for other valuable consideration, or free of charge. UPF makes no contributions to candidates and does not coordinate with any candidate, campaign, or party, and contributor and supporter data is treated as falling within that prohibition. This restriction is absolute and is not subject to a fair-market-value or other exception.

A-1. What Counts as a “Sale.” For purposes of this Privacy Policy and of applicable state privacy laws, a “sale” or “sharing” of personal information means disclosing or transferring personal information to a third party in exchange for monetary consideration or for other valuable consideration. Other valuable consideration includes, without limitation, list exchanges, reciprocal or swap arrangements with other committees or organizations, participation in data cooperatives, and barter transactions in which no money changes hands. Where a state privacy law gives you the right to opt out of the sale or sharing of your personal information, we apply that right to all of these arrangements and not only to transactions for cash.

B. Your Consent. By providing your information to us through the Services, by making a contribution, by signing a petition, by signing up for communications, or by otherwise interacting with us, you expressly consent to our collection, use, sharing, rental, exchange, sale, and disclosure of your information as described in this Privacy Policy. If you do not consent, please do not provide your information to us. You may withdraw your consent to the sale or sharing of your personal information at any time, going forward, by following the instructions in Sections 9 and 10; where applicable state law gives you the right to opt out of the sale or sharing of your personal information, we will honor that right in accordance with that law.

C. Mobile Opt-In Data. Notwithstanding the foregoing, your mobile telephone number and your consent to receive text messages, as collected through our mobile messaging program, will not be shared with or sold to third parties or affiliates for their own marketing or promotional purposes; this information is shared only with service providers who help us operate the mobile messaging program and as required by law. Telephone numbers you provide to us other than through the mobile messaging program (for example, on a contribution form) are subject to the sharing described in Section 5.A.

D. Disclosure of Certain Information in User Submissions Intended to Be Disclosed. Certain information associated with a Submission may be intended for disclosure, such as your username. We will disclose any such information in connection with the display of, and other services relating to, such Submission, and by submitting a Submission on or in connection with the Services you affirmatively consent to the distribution of your information as described herein.

E. Service Providers, Owners, and Licensees. We may provide and disclose your information to operators, service providers, payment processors, and other third parties for the purpose of providing, offering, supporting, administering, and maintaining the Services, and providing the full range of content, activities, services, features, and functions offered on or in connection with the Services.

F. Additional Disclosures. There may be instances when we may access or disclose information without providing you a choice in the following circumstances: (i) to protect or defend the legal rights or property of UPF or its officers, employees, agents, and contractors (including enforcement of our agreements); (ii) to protect the safety and security of our Services and users; (iii) to protect against fraud or for risk management purposes; (iv) if we believe your actions violate this Privacy Policy or the Terms of Service; or (v) to comply with law or legal process, including our reporting obligations to the FEC described in Section 6.

6. Public Disclosure of Contributor Information Under Federal Law

UPF is a political committee registered with the FEC and is required by the Federal Election Campaign Act and FEC regulations to file periodic public reports of its receipts and disbursements. Federal law requires us to itemize on those reports the name, mailing address, occupation, employer, contribution date, and contribution amount of each individual whose contributions to UPF aggregate in excess of $200 in a calendar year, and the name, address, date, and amount for each entity contributor above the same threshold. Information reported to the FEC becomes a matter of public record and is published by the FEC on its website, where it may be viewed, downloaded, and used by anyone, including journalists, researchers, other organizations, and commercial data aggregators. This disclosure is required by law and cannot be waived by you or by us, and your rights under any state privacy law do not apply to information we are required to report to the FEC.

Federal law (52 U.S.C. § 30111(a)(4)) prohibits any person from selling or using information copied from FEC reports for the purpose of soliciting contributions or for commercial purposes, other than the names and addresses of political committees. That restriction applies to information obtained from FEC reports; it does not restrict UPF's use, sharing, or sale of the information you provide directly to us, as described in Section 5.

Some states also require political committees to make certain reports or disclosures under state law. Where applicable, we will comply with those requirements, and information disclosed under them may also become public record.

7. Data Collection From Children

This website complies with the Children's Online Privacy Protection Act of 1998. We do not knowingly contact or collect personal information from children under the age of 13 without appropriate parental notice and consent, and our Services are not intended to solicit information of any kind from children under the age of 13. Contributions to UPF must be made by individuals who are at least 18 years of age. If we are informed that we have unintentionally received personal information from a child under the age of 13, we will delete that information. If you want to notify us of our possible receipt of information from children under the age of 13, please contact us at info@unitedprinciplesfund.org. Please visit the Federal Trade Commission's children's privacy page for information from the FTC about protecting children's privacy online.

8. Security

While no data transmission over the Internet is 100% secure from intrusion, we maintain reasonable physical, electronic, and procedural safeguards to protect your information. However, it is possible that third parties may unlawfully intercept or access transmissions or private communications despite our efforts to prevent this, and we therefore make no guarantees regarding the security of user information.

9. Your California Privacy Rights

A. Applicability. The California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA"), applies to for-profit "businesses" that meet certain thresholds. UPF is a not-for-profit political committee and does not believe it is a "business" subject to the CCPA. Nevertheless, as a courtesy to California residents, we voluntarily honor the following requests to the extent described in this Section. Nothing in this Section applies to information we are required by federal law to collect, retain, or report to the FEC, or to information that is otherwise publicly available.

B. Notice of Sale and Sharing. As described in Section 5, we sell and share personal information as those terms are defined under the CCPA. The categories of personal information we may sell or share include identifiers (such as name, email address, telephone number, and mailing address), contribution and transaction information, and, through Tracking Technologies, Internet or other electronic network activity information and inferences drawn from it. We do not knowingly sell or share the personal information of consumers under 16 years of age. We do not use or disclose "sensitive personal information" for purposes other than those permitted by the CCPA.

C. Right to Opt Out of Sale or Sharing ("Do Not Sell or Share My Personal Information"). If you are a California resident, you may direct us not to sell or share your personal information. To exercise this right, send an email to info@unitedprinciplesfund.org with the subject line "Do Not Sell or Share My Personal Information," or write to us at United Principles Fund, Attn: Privacy Requests, [MAILING ADDRESS]. Please include your full name, email address, telephone number, and mailing address so that we can locate your records and apply your request across the channels through which we communicate with you. We will also honor a Global Privacy Control signal from your browser as an opt-out request for the browser from which it is sent, as described in Section 4.D. Once we process your request, we will not sell or share your personal information going forward unless you later authorize us to do so; we cannot retrieve information already provided to third parties before your request.

D. Other Rights. Subject to the exceptions and limitations set out in this Section, California residents may also request that we (i) disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the purposes for collection, and the categories of third parties to whom we have sold, shared, or disclosed it; (ii) correct inaccurate personal information; (iii) delete personal information we have collected from you, subject to legal retention requirements, including FEC recordkeeping rules that require us to retain contribution records for at least three years; and (iv) limit the use of sensitive personal information. We will not discriminate against you for exercising any of these rights. You may designate an authorized agent to make a request on your behalf; we may require proof of the agent's authority and verification of your identity.

E. Shine the Light. Under California Civil Code Section 1798.83, California residents may request certain information about the disclosure of personal information to third parties for their direct marketing purposes during the preceding calendar year. Because we provide the opt-out right described in Section 9.C, we may respond to such a request by informing you of that right and how to exercise it. To make such a request, email info@unitedprinciplesfund.org or write to United Principles Fund, Attn: Your California Privacy Rights, [MAILING ADDRESS]. All requests must be labeled "Your California Privacy Rights" on the email subject line or envelope; include your name, street address, city, state, ZIP code, and email address, and indicate whether you prefer a response by email or postal mail. We will not accept requests via telephone or fax. We are not responsible for notices that are not labeled or sent properly, or that do not contain complete information.

10. Privacy Rights of Residents of Other States

Virginia, Colorado, Connecticut, Texas, Oregon, New Jersey, Delaware, Maryland, Minnesota, and a growing number of other states have enacted comprehensive consumer privacy laws that give their residents rights with respect to personal data, including, in most cases, the right to opt out of the sale of personal data and of targeted advertising, and rights to access, correct, delete, and obtain a copy of personal data. Many of these laws exempt nonprofit organizations and political organizations from their scope (for example, the Virginia, Connecticut, Texas, Utah, Iowa, Tennessee, Montana, Nebraska, and New Hampshire statutes), while a number of others provide no meaningful nonprofit exemption and may therefore apply to organizations such as UPF — including the Colorado, Oregon, New Jersey, Delaware, Maryland, and Minnesota statutes. Rather than applying different practices in different states, we honor verified opt-out, access, correction, deletion, and portability requests from residents of every state, regardless of whether a particular statute applies to UPF by its terms. In addition, most of these laws exempt data that is publicly available or that is processed to comply with federal law, and federal election law preempts state law with respect to the reports and disclosures UPF is required to make to the FEC.

To the extent a state privacy law applies to UPF and gives you a right to opt out of the sale of your personal data or of targeted advertising, you may exercise that right by emailing info@unitedprinciplesfund.org with the subject line "State Privacy Opt-Out Request" and your state of residence, or by writing to United Principles Fund, Attn: Privacy Requests, [MAILING ADDRESS]. We will honor such a request going forward as required by the applicable law. Where a state privacy law applies to UPF, you may also submit requests to access, correct, delete, or obtain a copy of your personal data through the same channels; we will respond within the time required by that law, may need to verify your identity before responding, and may decline requests that fall within a statutory exception (including our obligation to retain records under FEC regulations). If we decline to act on your request, we will tell you why and, where the applicable law provides an appeal process, how to appeal. Where a state law does not apply to UPF, we will still consider opt-out requests in good faith and will generally honor them for the state resident's contact information as a courtesy, but we are not legally required to do so.

11. Integration of Third-Party Platforms and Services

The Services may be linked to, rely on, and/or be integrated with websites, applications, interfaces, services, and/or platforms operated by third-party companies, including service providers, payment processors, and Third-Party Platforms. We are not responsible for the privacy practices of any websites, applications, interfaces, services, and platforms operated by such third parties that are linked to, rely on, and/or are integrated with the Services. Once you leave the Services via such a link, or access a third-party application, interface, service, or platform, including Third-Party Platforms and websites operated by service providers, you should check the applicable privacy policy of such third party to determine, among other things, how it will handle any personally identifiable or other information that it may collect from you.

12. Privacy Policy Changes

From time to time, we may modify this Privacy Policy to reflect industry initiatives, third-party requirements, or changes in the law, technology, our information collection and use practices, or the features and functionality of the Services, and such modifications shall be effective upon posting. When we change this Privacy Policy in a material way, a notice will be posted on our website along with the updated Privacy Policy. Your continued use of the Services after we post a revised Privacy Policy (and, where appropriate, notify you of this change) signifies your acceptance of the revised Privacy Policy. It is therefore important that you review this Privacy Policy regularly to ensure you are updated as to any changes. We may also seek your affirmative consent to the terms of the updated Privacy Policy. For example, we may ask for your consent before implementing new uses of the personal information that we have already collected from you, if such new use was not addressed by the privacy policy under which such information was collected.

13. Accuracy

It is your responsibility to give us current, complete, truthful, and accurate information, and to keep such information up to date. We cannot and will not be responsible for any problems or liability that may arise if you do not give us accurate, truthful, or complete information, or you fail to update such information. We will reject and delete any entry that we believe in good faith to be false, fraudulent, or inconsistent with this Privacy Policy.

14. International Usage

The Services are controlled, operated, and administered entirely within the United States and are intended for use by persons located in the United States. UPF may not lawfully accept contributions from foreign nationals. If you visit, access, interact with, and/or otherwise use the Services from a location outside the United States, please be advised that any information you provide in connection with any such activity may be processed in and/or transferred to the United States of America and/or other territories and locations, where privacy protections may not be as comprehensive as those in the territory or location where you interact with or otherwise use the Services. By using the Services, you affirmatively consent to the transfer, use, disclosure, provision, and other administration of your information as described herein.

15. Contact Us
